Provision of additional customer inquiry and communication services


This document sets out the rules that apply to the provision of the following services:

- Automated Balance Inquiry
- Missed Call Notification
- Pay For Me SMS-Notification
- Call Me SMS-Notification

Operator offers its subscribers the Services on the terms and conditions given below (the Services).
According to Article 395 of RK Civil Code, the Services constitute an offer to the Subscribers (the Offer).
A Corporate Client agrees that actions involving subscription to, control, use and deactivation of Services by any user in a Corporate Group of the Corporate Client shall be deemed to have been performed by the Corporate Client.
In this document, actions and / or inactions of the Corporate Client shall also mean actions and / or inactions of the Service user.

For the purpose of these Rules the following terms and definitions shall be used:
Subscriber inquiry refers to all or any of the following: SMS-inquiry, USSD-inquiry (*XXX#) or voice call to short codes.
Corporate Client (subscriber) refers to a legal entity or a person (individual entrepreneur) who are subscribed to and use the Operator’s corporate services. Any other terms used herein shall have the meanings ascribed to them in Public Mobile Communication Services Agreement.

1. Activation of Services
1.1. Services are available to all Subscribers. No additional activation is required.

2. Provision of Services
2.1. Services are available provided the Subscriber’s mobile terminal is turned on.
2.2. The list of inquiries is given in the Annex hereto.
2.3. By sending inquiries the Subscriber agrees that, in addition to the information related to a particular Service, Operator may also provide information about its services and promotions as well as third party goods and services, and gives consent to receive such information.
2.4. Operator does not guarantee supply of Services to the Subscriber in case the Subscriber’s mobile terminal is not capable of sending certain types of Inquiry.
2.5. Operator does not guarantee supply of Services to roaming Subscriber.
2.6. By accepting this Offer, the Subscriber agrees to the above limitations on Services provision. If the Subscriber does not agree to use the Services subject to the above listed limitations, the Subscriber may refuse to use them and make any inquiries.

3. Service charge and payment terms
3.1. Inquiries referred to herein are not chargeable.

4. Service conditions
4.1. Sending by the Subscriber / Corporate Client user of the initial inquiry shall be deemed the Subscriber’s entire and unconditional consent to these terms and condition (acceptance of Offer) and shall imply modification and/or amendment of the contract between Operator and Subscriber.
4.2. These Rules shall come in force upon being published on the Operator’s www.kcell.kz and www.activ.kz websites and continue in effect until amended or termination by Operator. The Subscribers shall be notified of any change in or termination of these Rules via announcement on Operator’s website published at least 10 (ten) days prior to the effective date thereof. These Rules shall be deemed to have been changed or terminated on the date stated in the relevant notice.
4.3. Change and/or termination of these Rules in accordance with cl. 4.2 hereof mean any change and/or termination of respective modification and/or amendment of the Contract resulted from the Subscriber’s acceptance of the Offer specified in cl. 4.1 hereof.
4.4. Provided the Subscriber has not notified Operator of refusal to accept modifications/amendments to the Contract within 10 (ten) business days after such modifications and/or amendments (resulting from the Subscriber’s acceptance of the Offer specified in cl. 4.1 hereof) came into force, such modifications/amendments shall be deemed to have been accepted by the Subscriber. If the Subscriber continues using the Service(s) after such modifications/amendments came into force, such modifications/amendments shall be deemed to have been accepted by the Subscriber.

Annex to the Rules of PROVISION OF ADDITIONAL CUSTOMER INQUIRY AND COMMUNICATION SERVICES

Automated Balance Inquiry

Service description: service that allows the Subscribers to instantly receive their account balance information via USSD and SMS inquiries and voice calls to a short number.

Inquiry types:


- USSD-inquiry: *123*3*1#
- USSD-inquiry: *100#
- USSD-inquiry: *111#

Missed Call Notification (MCN)


Service description: service that allows the Subscribers to receive information on calls missed over the past 24 hours, while the Subscriber’s mobile terminal was turned off or our of the network coverage area.
Using this Service, you will always know who called in the past 24 hours while you were out of coverage area or your mobile phone was turned off. Once you are back in coverage area or turn your phone on, you will receive a SMS listing your missed call details, including caller number, time and date.
To activate this Service, forward your calls to 2050 (Call Forwarding, Our of coverage area/Switched off option). To deactivate it, cancel call forwarding to 2050.

Inquiry types:

- USSD-inquiry: set up unconditional call forwarding (forward all incoming calls) to 2050 via **21*2050#
- USSD-inquiry: set up call forwarding “when busy” to 2050 via **67*2050#
- USSD-inquiry: set up call forwarding “when out of coverage/switched off” to 2050 via **62*2050#
- USSD-inquiry: set up call forwarding “no answer” to 2050 via **61*2050#

Pay For Me

The ‘Par For Me’ service allows you to send a free of charge message to the desired Kcell or Activ subscriber requesting him/her to recharge your balance, regardless of whether you are roaming or have run out balance.
To send a balance recharge request simply dial *130*recipient’s number#.
The number can be entered in either national or international format. For instance: *131*8ХХХХХХХХХХ# или *131*+7ХХХХХХХХХХ#.

Special conditions:


To avoid spam, the number of requests is limited to 5 requests per day and to 30 requests per calendar month.
The recipient will receive a SMS sent on your behalf saying “Subscriber ХХХХХХХХХХХ asks you to recharge his/her mobile account”.
After you dial *131* recipient’s number#, you will receive a USSD message confirming that your request has been sent out: “You request has been accepted”.

Call Me

When you are roaming or have run out of balance, use the ‘Call Me’ service to send a free of charge call me message to the desired Kcell or Activ subscriber.
To send a call me request, dial *130*recipient’s number# on your phone.
The number can be entered in either national or international format. For instance: *130*8ХХХХХХХХХХ# or *130*+7ХХХХХХХХХХ#.
The recipient will be sent a SMS containing your callback request.
Special conditions
To avoid spam, the number of ‘call me’ requests is limited to 5 requests per day and to 30 requests per calendar month.
The desired subscriber will receive a SMS sent on your behalf saying “Subscriber ХХХХХХХХХХХ wants you to call him/her back”.
After you dial *130*desired subscriber’s number#, you will receive a USSD message confirming that your request has been sent out: “You request has been accepted”.
