Content - Providers
• Service - services of the Provider, rendered to the Users through the access ensured by the Operator to the Provider’s content via the GSM network using the Technology.
• Content – a substantial part of the Service. SMS, USSD, voice including IVR, MMS, WAP, GPRS and other technologies, implemented within the scope of Technology, may represent a transport medium for content transfer from the Provider to the User.
• Digital Identifier – a number from the Number capacity of the Operator, consisting of a set of figures and letters, or combinations thereof, and used to render the Provider’s Service to the Users.

- Certificate of no outstanding tax liability issued by Tax Committee.

Bulk SMS
• Bulk SMS - automated dissemination of multiple text messages to a target group of recipients.
• Spam – dissemination of information and/or content which is neither solicited by users nor related to the service used.
• Digital Identifier – a number out of Operator’s Numbering Capacity; it is a combination of digits used to send bulk SMS.
• Alphanumeric identifier – alphabetical reference to the sender of bulk SMS.
• According to Rules of Rendering mobile communication services approved by AIC Order #33 of 2 January 2009, dissemination of advertising text messages to multiple recipients over mobile networks is allowed provided their consent has been obtained (par. 25.37 of Rules).
• Recipient can give consent:
In writing – a questionnaire form signed by the recipient and containing his/her personal details.
Electronically – a questionnaire form containing his/her consent is filled in online,
Via SMS – a text message containing his/her consent sent to provider’s digital identifier.
Key requirements – recipient can be identified and his/her consent (filled in questionnaire form) can be provided immediately upon Operator’s request.
*Where a Provider is found to have disseminated information and/or content which has not been solicited (Spam) or is not a part of the Service,
Operator may disconnect such Provider from the Technical Solution with no prior notice and claim a penalty of 70 (seventy) tenge per each disseminated message,
which, however, may not be less than 1 000 000 (one million) tenge. Operator may refuse to pay remuneration to the Provider under the digital identifier contract.
Dissemination of Spam can also serve as a ground for Operator’s unilateral termination of the contract.
